CribGourmet Seller Agreement

Seller-specific agreement. This Seller Agreement is between you and Crib Gourmet LLC and supplements the CribGourmet Terms of Service. By claiming, creating, managing, or publishing a cook page, you make the promises below personally and, if applicable, for the business you are authorized to represent.

1. Authority and ownership claims

You represent that you are at least 18 or the age of legal majority where you live and are the owner of, or fully authorized to act for, the listed cook or food business. Claiming a page transfers platform control; it does not transfer legal ownership of a business, name, content, customer relationship, or other property.

You will provide accurate proof of identity, authority, ownership, licensing, or contact information if reasonably requested. You will promptly tell us if your authority ends. An operator-created or unclaimed page does not mean the seller participated in, approved, or was verified by CribGourmet.

2. Independent seller relationship

You are an independent seller and control whether, what, when, where, and how you offer food, subject to law. CribGourmet is a directory and direct-connection tool, not your employer, agent, partner, franchisor, restaurant, caterer, payment processor, delivery provider, insurer, inspector, or legal adviser.

You have no authority to bind CribGourmet, make promises for us, collect money for us, or represent that we licensed, inspected, certified, approved, sponsored, insured, or guaranteed you, your kitchen, your products, or your performance.

3. Your duty to determine whether you may sell

Before publishing or accepting any request, you must independently determine that you may lawfully advertise, prepare, package, store, sell, fulfill, and deliver each item in every location involved. If your authority is absent, expired, suspended, restricted, or uncertain, do not publish or transact until you receive competent guidance or authorization.

Your responsibilities include all applicable cottage-food, retail-food, catering, restaurant, health-department, zoning, home-occupation, business-registration, permit, inspection, food-handler, commercial-kitchen, sales-channel, sales-limit, shipping, and delivery rules. A law allowing some home-produced foods does not necessarily allow catering, hot meals, refrigerated foods, meat, dairy, seafood, wholesale, online sales, or third-party delivery.

CribGourmet does not decide whether an exemption or license applies and has no duty to inspect your kitchen, documents, or products. Our allowing a page to remain visible is not legal approval.

4. Food safety, ingredients, and allergens

You are solely responsible for safe sourcing, preparation, sanitation, cross-contact controls, temperature control, storage, packaging, labeling, transport, and handoff, and for complying with required recalls or notices.

You must provide accurate ingredient and allergen information required by law and answer customer questions honestly. You may not claim that food is allergen-free, disease-preventing, medically suitable, certified, organic, halal, kosher, vegan, gluten-free, or otherwise specially qualified unless the claim is truthful, substantiated, and lawful. You are responsible for communicating that a home kitchen may handle common allergens when applicable.

5. Accurate listings and rights to content

Your business name, identity, location, service area, contact methods, menu, photos, prices, availability, portions, ingredients, allergens, licensing statements, fulfillment terms, and other claims must be current, clear, and not misleading. Promptly correct a material change or error.

You represent that you own or have permission to use every name, logo, photo, description, menu, and other item you submit. You grant the content license in the Terms of Service so we may operate and promote your page. You remain responsible for permissions from photographers, employees, contractors, customers, or other people shown or identified.

6. Orders, pricing, payments, taxes, and records

Unless separately agreed in a future CribGourmet transaction service, every inquiry, quote, acceptance, order, payment, tip, tax, cancellation, refund, chargeback, complaint, and dispute is directly between you and the customer. You choose and are responsible for any third-party payment method. CribGourmet does not receive, hold, safeguard, settle, or refund customer-to-seller funds.

Before accepting an order, clearly communicate the total price, deposits, payment timing, quantity, pickup or delivery plan, cancellation and refund policy, and important limitations. You are solely responsible for collecting, reporting, and remitting taxes and fees and maintaining records required for food safety, licensing, accounting, and disputes.

A fee you pay CribGourmet for Premium or another platform feature is governed by the subscription provisions in the Terms and is not a commission, escrow, or payment for a customer's food order.

7. Pickup, delivery, catering, and large orders

You are responsible for safe and lawful pickup instructions, access, handoff, packaging, temperature control, timing, and proof appropriate to the transaction. If you or a third party delivers, you are responsible for determining whether the item and delivery method are lawful and whether special licenses, commercial auto coverage, carrier terms, or customer disclosures apply.

Catering, staffed service, large-volume orders, hot holding, venue service, and delivery can trigger rules different from cottage-food sales. Do not describe or perform those services through CribGourmet unless you have confirmed and continue to hold every required authorization and insurance.

If an integrated delivery option is later offered, a quote or courier request will not make CribGourmet the food seller or relieve you of packaging, driver handoff, customer communication, cancellation, safety, or legal duties. Provider limits and separate terms will apply.

8. Customer service, refunds, and safety reports

You are responsible for responding to customers, honoring your stated terms, addressing missing or incorrect items, handling refunds and chargebacks, and responding appropriately to illness, allergen, contamination, injury, or recall concerns. Do not ask a customer to waive rights that cannot lawfully be waived or to suppress an honest review.

Promptly notify CribGourmet of a credible safety incident, government inquiry, recall, loss of authority, or ownership dispute that materially affects your page or users. Cooperate with reasonable information-preservation and safety steps. Reporting to us does not replace any duty to contact customers, health authorities, insurers, law enforcement, or other appropriate parties.

9. Insurance and professional advice

You are responsible for determining and maintaining appropriate business, product-liability, general-liability, property, auto, workers' compensation, or other insurance. CribGourmet does not provide coverage. You should consult qualified legal, tax, licensing, food-safety, and insurance professionals for your circumstances.

10. Reviews and platform integrity

You may respond to or report a review, but you and anyone acting for you may not review your own business; create or use fake, duplicate, borrowed, or coordinated customer accounts; ask a person without a genuine first-hand experience to review you; use a nonexistent or AI-generated reviewer; buy, sell, trade, broker, or exchange reviews; arrange reciprocal reviews; reuse a review from another business or offering; submit or arrange a negative review of a competitor; or otherwise misrepresent who wrote a review or what they experienced.

You may neutrally invite genuine customers to leave honest feedback, but CribGourmet does not permit money, discounts, refunds, free food, gifts, contest entries, or other benefits in exchange for posting, changing, or removing a review. You may not condition any benefit expressly or implicitly on positive or negative sentiment, selectively ask only customers expected to be positive, route dissatisfied customers away from the review process, require private contact before a negative review, pressure a reviewer to change or delete an honest review, or use threats, intimidation, retaliation, groundless legal claims, or knowingly false accusations against a reviewer.

You must not direct employees, agents, contractors, relatives, friends, customers, marketing providers, reputation-management firms, or any other person to bolster your rating or engagement, evade a platform restriction, manipulate helpfulness votes, or distort ranking, recommendation, or customer sentiment. You are responsible for review manipulation performed at your request, for your benefit, or by someone acting on your behalf. Nothing in this Agreement limits a customer's legally protected right to share an honest opinion.

Premium status or promotional placement may affect presentation or ranking as disclosed by the product, but does not represent safety, quality, licensing, inspection, or endorsement.

11. Access, moderation, and ownership disputes

We may request corrections or evidence, limit visibility, pause messaging, suspend a claim, transfer control, or remove a page or account when we reasonably believe there is a legal, ownership, intellectual-property, food-safety, fraud, nonpayment, or platform risk. We may preserve available records and cooperate with lawful authority.

We are not required to adjudicate business ownership or private disputes. You are responsible for pursuing appropriate legal remedies, and you release us from responsibility for good-faith interim claim or moderation measures to the fullest extent permitted by law.

12. Seller indemnification

In addition to the indemnity in the Terms of Service and to the fullest extent permitted by law, you will defend, indemnify, and hold harmless Crib Gourmet LLC and its members, owners, officers, employees, contractors, and service providers from third-party claims, losses, liabilities, damages, judgments, penalties, recalls, chargebacks, and reasonable legal costs arising from or related to your business; food or other products; illness, injury, allergy, contamination, or property damage; content or listing; license, permit, tax, labeling, pickup, delivery, catering, employment, privacy, or intellectual-property obligations; transaction or customer dispute; or breach of this Agreement.

This obligation does not apply to the extent a claim was caused by Crib Gourmet LLC's own conduct for which indemnification cannot lawfully be required. The defense and settlement process in the Terms applies.

13. Incorporation, changes, and survival

The CribGourmet Terms of Service and Privacy Policy are incorporated into this Agreement. If this Agreement conflicts with the general Terms on a seller-specific issue, this Agreement controls.

We may update this Agreement prospectively and require fresh affirmative acceptance before you claim, publish, manage, or continue seller actions. Duties concerning prior transactions, records, content, reports, payment, liability, indemnity, and disputes survive suspension, transfer, unpublishing, or termination.

14. Electronic acceptance and contact

Your acceptance may be associated with your verified account, document version and cryptographic hash, time, language, claim or publish action, and minimized technical evidence. You agree that these records may be used to reproduce and establish your acceptance, subject to applicable law.

Questions, ownership disputes, and safety reports for Crib Gourmet LLC may be sent to hello@cribgourmet.com. Emergencies and legally required reports must also go directly to the appropriate public authority.

This Agreement supplements the Terms of Service and Privacy Policy.
